TERMS AND CONDITIONS OF SALE

Terms and conditions apply to all orders placed for products identified on the company’s order system.  Please read them carefully.  By entering the site and placing an order with us you are accepting the Terms and Conditions set out herein.

The “company” is R.N.R. Charlesworth, trading as The Badger Press, 39 Clay Close, Dilton Marsh, Westbury, Wiltshire, BA13  4DU, United Kingdom.  VAT registration number 137 5423 70.  Product names used include Nick Charlesworth Postcards, Vaudeville-Postcards and Badger Postcards.

We reserve the right to alter, suspend or discontinue any aspect of this web site or its content or the goods and services available via it.  Further, unless otherwise stated, any new features including new content and or the sale of new goods, shall be subject to the terms and conditions.

1. Payment:  All payments must be made at time of purchase and are made subject to acceptance by you of the site’s terms and conditions.  Fulfilment of the order is subject to stock availability and acceptance of your order, and the company is under no obligation to fulfil your order.  If you do not wish to pay on line there are alternatives: Complete your order as usual.  Print your order to your printer.  Post the order to us with a Sterling cheque (drawn on a UK bank).  Note that for cheque payments the order will be acknowledged and goods despatched once funds have cleared through the bank.  Your name, address and cheque card number must be written on the back of your cheque, which should be made payable to ‘R.N.R. & W.M. Charlesworth’  If you experience any ordering difficulties or have any concerns, please phone or email us.  Please ensure you leave the correct contact details.

2. Prices: Prices shown are accurate at a certain date but are subject to change.  Any change will be advised to you where applicable and will be shown on the web site as soon as possible.

3. Currency:  All prices quoted on this web site are in pounds sterling and include VAT at the current rate where applicable.  Payment must be made in pounds sterling (credit/debit card sales will be charged in you local billing currency by your credit card provider).

4. Shipping/Carriage:  The final price quoted on the payments page is the price of the goods including standard delivery to the stated destination.  Please ensure you highlight the correct country for shipping.  These charges include carriage by our nominated carrier(s).

5. Delivery:  All goods to UK and overseas addresses will be despatched within seven days of confirmation of payment by post.  If we are unable to despatch within the stated period we will inform you.

6. Goods not available for shipment:  In the event that we cannot ship your goods within the stated time, due to their not being in stock, we will contact you to offer you the opportunity to cancel your order.

7. “Sale or Return”:   We regret that goods are not supplied on a “Sale or Return” basis.  It is essential to use correct reference numbers and/or book title when you order goods because we regret refunds cannot be made.

8. Damage in Transit: Sometimes, though rarely, goods get damaged in transit.  If this happens with your shipment please advise us within 48 hours.  However, since we never knowingly ship damaged goods, we need your help to try to recover our costs from the carrier wherever possible.  If you do receive damaged goods please retain all relevant documentation, packaging and goods so that a claim can be made against the carrier.  Please contact us by email or phone with as much detail of the damage as possible so that we can arrange a replacement.  Please do not return damaged goods unless and until requested to do so as this may incur additional costs unnecessarily.

9. Disclaimer: We promise that all goods you purchase will be of satisfactory quality.  To the extent permissable by law we exclude all other express or implied terms, conditions, warranties, representations or endorsements whatsoever with regards to the products, our web site or any information or service provided through our web site.  We shall use our reasonable endeavours to ensure that all materials and information published on our web site is accurate.  However, you accept that no warranty is given by the company in this respect and that you will make your own enquiries where appropriate.

In relation to the purchase of goods, we accept no liability for indirect or consequential loss or damage, or for any loss of date, profit or revenue or business (whether direct or indirect), however caused even if foreseeable.  In circumstances where you suffer loss or damage arising out of or in connection with the viewing, or use of our web site or its contents or other as a direct result of purchasing goods, we accept no liability for this loss or damage whether on the part of the Company or our servants, agents or any other person.

Nothing in these terms shall limit or exclude liability for death or personal injury caused by the negligence of the Company or its employees or any damage caused by a defective product without the means of the Consumer Protection Act 1987.

10. Jurisdiction:  These terms and conditions are subject to English law and the parties hereby submit to the jurisdiction of the English courts.  None of these terms and conditions affects your statutory rights as a customer.

11. Privacy:  We are committed to protecting your privacy.  When you place an order we need to collect certain information in order to process your order, ie your name, address, contact telephone number, email address and credit/debit card details.  The information is sent to us via an SSL encrypted server.  This information will form part of a permanent record of your dealings with us.  We will not email you in the future unless you have given us your consent.  We do not sell, trade or rent out your personal information to any third parties.

12. Security:  The purchase area of our web site is secure.  This means that we utilise industry standard Secure Sockets Layer (SSL) technology to allow for the encryption of potentially sensitive information such as your name and address and critically sensitive information such as your credit/debit card details.  Information passed between your computer and our web site cannot be read in the event of it being intercepted by someone else.

13.  Linking:  We are not responsible for the content or reliability of any linked web sites and any link is not intended to be, nor should be construed as, an endorsement of any kind by us of that other web site.

Intellectual Property:  The contents of our web site are protected by international copyright laws and other Intellectual Property Rights.  The owner of the rights is the Company and other third party licensors.  All product and Company names mentioned in our web site are trade marks, service marks or trading names and their respective owners, including us.

You may download material from our web site for the sole purpose of placing an order with the Company or using the web site as a shopping resource.  However, you may not modify, copy, reproduce, re-publish, upload, post, transmit or distribute by any means or in any manner, any material or information on or downloaded from our web site, including but not limited to, text, graphics, video, messages, code and/or software without our prior written consent, except where explicitly invited to do so, for example in order to complete any test or questionnaire.

15.   Privacy Statement: This privacy statement sets out how the company complies with European Union data protection requirements.  This applies to the entire web site.

We are committed to respecting your privacy and have structured our web site so that, in general, you can visit the Company on the web without identifying yourself or revealing any personal information.  Once you choose to provide us with any information by which you can be identified then you can be assured that it will only be used in accordance with this privacy statement.

What we collect
We require that you supply personal information including name, email addresses and credit/debit card details, prior to submitting your order.  Please do not forget to supply full postal address to where goods are to be sent.

What we do with the information we gather
We require this information for the following reasons: Internal record keeping.  We may also use it to contact you in case of query or from time to time to inform you of new products or special offers.  We may follow up information provided by you in order to improve our products and services or for market research  purposes.

Who we share information with and your choices
When you use this site and have not advised us to the contrary, you are agreeing that we may use your personal information for the purposes set out in this statement. We will not sell, distribute or lease your personal information to third parties unless we are required to do so by law.
